Comment on Uber at the Court of Appeal
The Court of Appeal is hearing the Uber worker status case today and tomorrow. Commenting on this, Mishcon de Reya Employment Partner Susannah Kintish, who represented Pimlico Plumbers in its worker status case at the Supreme Court earlier this year, said:
"Today sees the Court of Appeal turn its attention to the question of worker status in a case that could decide the future of Uber, if not the gig economy. However, in common with other cases determining worker status, the facts of this case are quite fact specific, so we are unlikely to see principles emerge of general applicability. This is likely to mean continued uncertainty around worker status for both employers and workers operating in the gig economy. The government's consultation earlier in the year, on which we are awaiting a response, was clearly an attempt to start addressing these concerns, but clarity - so far - remains elusive."
